Get approval for Section 68 activities

Some business signs can be erected without development consent if they meet the prescribed development standards that are listed in the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.

Altering existing street awnings and installing new awnings is also permitted under the SEPP where the development standards are satisfied and in line with Section 3: General provisons of the Sydney Development Control Plan 2012.

To install signage and awnings over a public road including footpaths you must apply to the City for approval. For awnings, you will also require a complying development certificate (CDC).

A CDC cannot be issued until the City of Sydney has approved the signs or awnings to be installed or altered above a footpath.

Either the City of Sydney or a private accredited certifier can issue a CDC. To have the City of Sydney issue a CDC, complete and lodge an application.

Installing and operating amusement rides requires approval under the Local Government Act 1993. Amusement devices are also regulated through the Work Health and Safety Act 2011.

An amusement ride is equipment operated for payment that provides entertainment, sightseeing or amusement through movement of the equipment or part of it, or when passengers travel on, around or along the equipment.

Amusement rides do not include:

• miniature trains and railway systems owned and operated by a model railway society, club or association,
  a ride or device that is used as a form of transport
• a boat or flotation device that is solely propelled by a person who is on the boat or floatation device which is not attached to any mechanical equipment or does not rely on artificial water flow to move
• any equipment that is specifically designed for sport, professional stunts, theatre or acrobatics
• coin or token operated rides that are not ridden by more than 4 children under 10 years in a shopping centre or public place and does not necessarily have an operator.

Amusement devices covered by section 2.1 of AS:3533.1:2009 (Amusement rides and devices – Design and construction), except devices specified in subclause (1C), are high risk plant (Part 1.2 clause 10(1B) Work Health and Safety Regulation 2017) and are therefore amusement devices in terms of the Local Government Act and therefore require approval.

To assess and grant approval for amusement rides, the City must be satisfied that certain standards and requirements are met under clauses 72 and 74 of the Local Government (General) Regulation 2005 including:

• the ground or other surface where the ride is to be located is sufficiently firm to sustain it during operation
• the ground or other surface is not dangerous due to its slope, irregularity or for any other reason
• the ride is registered under the Work Health and Safety Regulation 2017
• the ride is erected in accordance with all conditions (if any) relating to its erection set out in the current certificate of registration issued for the device under the WHS Regulation
• the ride has a current log book
• valid and current unlimited indemnity insurance for no less than $10 million.
